GENERAL PROVISIONS
PAYMENT METHOD
1. The parties agree that payment will be made by check or bank transfer to a bank chosen by the videographer within 7 days. In the event of payment by check, the latter must be delivered on the same day and in person.
2. In the event that the client fails to pay the agreed payment within the agreed period, the videographer may decide to terminate the contract. In this case, the booking fees are not refundable.
3. The videographer is a self-employed worker, and is not an employee of the client.
SOCIAL MEDIA USE AND RIGHTS ON THE WORK
1. The videographer transfers to the client all rights to the FINAL video work, including property rights and copyrights.
2. the client is not entitled to request the ''rush'', i.e. the audiovisual files, from the videographer under any circumstances.
3. The videographer is entitled to publish the videos, without time or geographical restrictions, in a reworked version, on his website and on social media.
TIME ALLOWED FOR THE EXECUTION OF THE WORK
1. No extension or modification of this contract will operate as a waiver of the latter. However, the videographer is not held responsible for a delay due to circumstances beyond his control.
2. The videographer carries out the work personally. if he is personally unable to perform the work for reasons beyond his control (e.g. force majeure, sudden illness, accident, etc.) he is obliged to inform the client immediately and to find another videographer to replace him, to the extent that this can reasonably be required of him and that the clients give their consent.
3. The client will check the quality of the videos as soon as they are delivered. If any footage is missing or if some of it has defects, the videographer will be informed in writing or by email;. The type and extent of the defects must be notified precisely.
CONFIDENTIALITY
The parties agree that the information and documents shared and disclosed under this contract will remain strictly confidential and exclusive to the parties concerned.
THE CONTRACT
1. This agreement is written in accordance with the laws of the State of Quebec. All work will be performed in a professional manner, and if applicable, in accordance with the law and building regulations.
2. Neither the videographer nor the client may assign this agreement to another party without the prior written consent of both parties involved.
3. This agreement, between the videographer and the client, constitutes its entirety, does not take into account any agreement preceding it. It does not take into account any promise or condition, oral or written, excluded in this contract.
4. The parties involved promise to implement this agreement within the expected time. Any changes made to this document must be signed by the videographer and his client.
THE CIENT acknowledges:
1. That he undertakes to compensate YANNICK PINSONNEAULT for any damages incurred in the event of negligence on his part.
BREACH OF CONTRACT
The client acknowledges:
1. That he may terminate this contract without cost or penalty 90 days before the videographer has begun to perform his main obligation by written notice.
3. That he agrees to pay a termination fee of 10% of the total amount if the contract is terminated 60 days before its entry into force; 25% if terminated 30 days before its entry into force; and 35% if terminated less than 30 days before the contract begins.
4. That he must pay the hours of work incurred since the beginning of the contract and in their entirety in the event of termination of the contract.
